Four hemp companies are taking legal action against the state, saying a new law could shut down their businesses. The law, which bans certain hemp products, is set to take effect Tuesday.

These four companies, Mellow Fellow Fun, Tasty Haze, The Humble Hemp Shack, and Seedless Green, say the new hemp law violates federal protections under the 2018 Farm Bill. They’ve filed a lawsuit against Gov. Kay Ivey and Attorney General Steve Marshall asking for a temporary restraining order to block the law before it kicks in.

It would ban the sale of certain hemp products. The Attorney General’s office says anyone caught with these certain products could face a class C felony. The companies say they haven’t been given any clear guidance on which products are banned and that it’s against the 2018 farm bill that legalized hemp nationwide.

The companies argue Alabama’s new law not only goes against that but also threatens to disrupt a growing industry that’s been boosting the state’s economy.

They also raise concerns about truck drivers who transport hemp through Alabama, saying this law could put them at risk of criminal charges just for doing their jobs.

There is a hearing in Montgomery on this issue Monday.
