INDIANAPOLIS (WPTA) – Indiana Governor Mike Braun signed a law Tuesday banning marijuana advertising in Indiana
The signature comes just one week after the Indiana General Assembly passed House Bill 1390 on April 29, the last day of the state’s 2025 legislative session.
HB 1390 primarily provides clarification on Bureau of Motor Vehicles procedures.
However, the bill also includes language prohibiting advertising in any medium for products containing marijuana or listed as a Schedule I controlled substance.
Currently, recreational marijuana use is legal in three of the states surrounding Indiana: Michigan, Ohio, and Illinois.
As a result, many of the states’ marijuana businesses have advertised in Indiana to encourage consumers to purchase and partake in the recreational activity while across the border.
Under the new law, any form of marijuana advertising within state lines could face fines of $5,000 for first-time offenders and $15,000 for repeat offenders.
The state notes that marijuana advertising under active agreement can not be canceled, and can legally remain up until 2035.
The law will be enforced by the Indiana Attorney General’s Office.
