COLUMBUS, Ohio (WSYX) — The Division of Cannabis Control (DCC) has issued updated guidance on Wednesday on purchase limitations for non-medical cannabis sales.
The DCC emphasized its priority of ensuring medical marijuana patients have an adequate supply while maintaining their medical marijuana cards. Dispensaries are reminded of their responsibility to serve both medical patients and non-medical consumers, maintaining sufficient inventory for medical marijuana.
Under the new guidance:
Dispensaries should adhere to statutory per day transaction limits for non-medical consumers as outlined in Ohio Revised Code (O.R.C.) 3780.03 and 3780.36. However, they are not mandated to dispense up to these limits. Medical patients and caregivers can continue purchasing amounts eligible for a 90-day supply according to Ohio Administrative Code (O.A.C.) 3796:7-2-04 and 3796:8-2-04.Dispensaries must prevent sales exceeding these transaction limits and are encouraged to work with point-of-sale system vendors to ensure compliance. Technical updates to point-of-sale configurations may be necessary to accurately reflect product ratios.Dispensaries opting to change non-medical cannabis sales transaction limits must submit a Change of Operations request and updated Standard Operating Procedures (SOPs) via the DCC eLicense portal.
The DCC reminds dispensaries to comply with all guidance, mandates, and directives, as well as applicable requirements under O.R.C. 3780 and 3796. Non-compliance may result in enforcement action.
For calculating transaction limits, only dried cannabis plant material for vaporization is approved for the 2.5 ounces of plant material limit. Other products apply towards the non-medical consumer’s cannabis product limitation of 15,000mg of total THC content. Dispensaries must verify THC content values in their systems to ensure accuracy.
While tracking non-medical purchases as “whole day units” is no longer required, dispensaries must continue tracking all medical marijuana sales as “whole day units” and submit them to the PMP for tracking within OARRS.
