AUSTIN, Texas — A controversial bill that would ban hemp-derived THC products in Texas now sits on Governor Greg Abbott’s desk, where his signature could determine the fate of an entire industry.
Senate Bill 3, which passed during the most recent legislative session, targets products such as Delta-8 and Delta-9 THC. If Governor Abbott neither signs nor vetoes the legislation by Sunday, it will automatically become law by September 1.
“S.B. 3 wipes out an entire industry that’s been here now for six years,” said Lukas Gilkey, founder of Hometown Hero, a Texas-based manufacturer and distributor of hemp-derived THC products. Gilkey has been vocal in his opposition to the bill, which he says threatens thousands of jobs and businesses. “Essentially, 99.99 percent of the industry will be wiped out as of September 1 if the governor either signs that bill or does not sign the bill.”
Supporters of the ban, including Lieutenant Governor Dan Patrick, argue the products are harmful and pose a threat to public safety. “These are people who want to kill your kids and they don’t give a damn,” Patrick said at a press conference earlier this month. “So we’ll fight this all the way.”

Opponents, including the Texas Hemp Business Council, dispute those claims. “It’s really giving people access to a product that does not cause any harm, despite the narrative,” a spokesperson for the council said. The Council also announced more than 150,000 people have signed a petition urging Governor Abbott to veto the measure. Despite mounting public opposition, Gilkey remains uncertain about the bill’s fate. “I personally believe that he’s not going to sign it. I think that might be the best political play for him,” he said. “We’re optimistic that we’ll get a veto.”
If Senate Bill 3 becomes law, possession of hemp-derived THC products could result in a Class C misdemeanor and a fine of up to $500. Repeat offenses may carry more severe penalties.
