LINCOLN, Neb. (WOWT) – The lawsuit filed late last year attempting to block the two initiatives that legalized medical marijuana in Nebraska was thrown out in district court Thursday.
The lawsuit filed by former State Sen. John Kuehn claimed the ballot measures violated the state and federal law. The head of the nonprofit Smart Apporaches to Marijuana argued that the measures are unconstitutional.
A Lancaster County judge found the man who filed the lawsuit didn’t have standing to sue.
The ruling comes on the same day the Nebraska Medical Cannabis Commission adopted emergency regulations.
Last November, Nebraskans overwhelmingly voted in support of legalizing medical marijuana and regulating. Seven of every 10 Nebraska voters said “yes.”
