A coalition of hemp product businesses and individuals in Maryland sued the governor and cannabis regulators, claiming the state’s laws illegally restrict federally permissible hemp products.

The plaintiffs, including hemp farmers, manufacturers, distributors, retailers, and a consumer, allege that Maryland’s 2023 Cannabis Reform Act unconstitutionally prohibits them from selling federally legal hemp-derived products containing THC while granting a monopoly to state-licensed cannabis dispensaries.

The complaint alleges the licensing scheme for cannabis businesses violates the plaintiffs’ rights to equal protection and due process by imposing arbitrary requirements like lotteries, social equity factors, diversity statements, and business plan reviews.
