KXLG – Watertown, SD The Watertown Police Department, in collaboration with the Codington County Sheriff’s Office, has seized over 2,000 illegal items, including certain THC and Delta products, from two local vape and smoke shops following search warrants executed on June 4, 2025. Illegal prescription medication was also confiscated during the operation.

These actions stem from the Watertown Police Department’s ongoing efforts to enforce state laws regarding the sale of certain cannabis-derived products. In July 2024, the department issued notices to local establishments informing them of upcoming changes to state law that would prohibit the sale of specific THC and Delta products.

On May 28, 2025, the Watertown Police Department conducted compliance checks at eight vape and smoke shops in Watertown. These checks aimed to ensure businesses were not selling legal THC products to individuals under the age of 21. Seven businesses passed these checks: America’s Smoke, Dakota Dispensary, Dakota Tobacco Co, Midtown Smoke, Smoke Solutions, Tobacco and Vape, and Vape Depot.

However, one business, Smokes R Us, was found to have sold Delta 8 gummies to an underage buyer. An employee at Smokes R Us was issued a citation for selling to an individual under 21.

Following these compliance checks and in response to additional complaints concerning illegal product sales, authorities executed the two search warrants in southeast Watertown. The investigation remains active, and additional charges are pending.

Under South Dakota law, products such as Delta 8, Delta 10, THCP, THCO, and HHC are illegal to sell. The Watertown Police Department stated that its goal is to prevent the illegal sale of these substances within the community. While some products may legally be sold to individuals 21 and older, similar to alcohol, adherence to state law is mandatory, and the department will continue to monitor businesses to ensure public safety and lawful operations.
