(WWJ) – Better Made? More like “Better Not” after the Michigan-based snack foods company filed a lawsuit against several cannabis companies for violating its trademark this week.
As reported by the Detroit Free Press, Better Made Snack Foods Inc., known for their potato chips and other snack foods around the Metro Detroit area, filed a trademark infringement lawsuit in U.S. District Court for the Eastern District of Michigan on Wednesday, March 27, accusing multiple companies using its bright red logo illegally on packages of cannabis flowers and edibles.
Better Made is seeking monetary damages and an order prohibiting the companies from using its trademark on their websites, packaging, advertising and manufacturing materials.
The defendants named in the lawsuit are IVP Holding, LLC, House Brands Distro, High Society 2, Zen Republic, LLC, Olswell Cannabis Company, Olswell-Adrian, The Earle of Smoke II, LLC, House of Dank Grand Rapids, Detroit Herbal Center, The High Club, Royal Highness, LLC, Herbology Cannabis Co., MJC Development, LLC, Cannabis King, Cafiero Family Ventures, LLC, King of Budz Ferndale, Carmen Selena Investments, LLC, Royal Highness PC3 LLC, Flower Bowl River Rouge, Greencare Provisioning LLC, Mid Ventures, LLC, Greencare Provisioning Center, Inkster Microbusiness LLC, Nar Inkster, Indica LLC, Sticky Muskegon, Lucky Pablo, Inc., Lucky’s Cannabis Company, Pure Buds, LLC, Quest Cannabis, NBT Group LLC, URB Cannabis, Parom Holdings, LLC, and URB Cannabis Company.
According to court documents, the popular snack food maker said improper use of its logo came to their attention in August 2023. Better Made claimed it sent the more than two-dozen companies several notices via email and mail to stop using its logo, but they did not receive a reply.
While its trademark disappeared from the defendant’s website, Better Made said it continued to be used. Officials for Better Made said customers notified the company in December 2023 and again in January of this year that trademark violations were still happening.
The cannabis companies were contacted by legal counsel for Better Made in January, February and March. Despite being told by the defendant’s lawyer that they would address the issue, Better Made’s logo continued to be used.
